MANILA - The Court of Appeals (CA) on Friday morning approved the writ of amparo petition filed by a lawyer of the Ampatuan clan in Cagayan de Oro City.
The CA branch in Cagayan de Oro City approved the amparo petition around 9 a.m..
The petition was filed Thursday by lawyers headed by Anwar Khalid Maliawao on behalf of the Ampatuan family.
Among the respondents to the petition were top military officials assigned to oversee security in Maguindanao.
The writ of amparo is a remedy of any person whose right to life, liberty and security is violated or threatened with violation by an unlawful act of ommission of a public official or employee.
The powerful political clan sought the CA's intervention, claiming police and military personnel have been "detaining" them inside their mansions in Shariff Aguak, Maguindanao.
The whole province has been placed under a state of emergency. Its provincial capitol in Shariff Aguak has also been placed under police and military control.
The lawyers of Datu Unsay town Mayor Andal Ampatuan Jr। on Thursday also filed a petition for bail before the Cotabato City Regional Trial Court, where 25 counts of murder were filed against him for his alleged involvement in the massacre of 25 people in Ampatuan town last November 23.Report from Rod Bolivar, ABS-CBN Cagayan de Oro
